The brother of a York man facing the death penalty for allegedly kidnapping and killing his girlfriend’s son entered a no contest plea Monday to one count of terroristic threats made against a criminal investigator at the county courthouse in November 2013.
Ummad Rushdi, 30, of the 900 block of Castle Pond Drive, York, is awaiting trial for the murder of his girlfriend’s 7-month-old son, Hamza Ali. Ali was reported missing from Rushdi’s parents’ home in Upper Darby by his mother, Zainab Gaal, 20, on Aug. 4. She claims Ummad Rushdi told her he could kill the child and get away with murder.
Investigators say Ummad Rushdi told his brother, Jawwad Rushdi, 33, that he had shaken Ali to death, then buried the him in an undisclosed location. No body has been recovered.
The older brother allegedly ran into Upper Darby Detective Edward Silberstein on Nov. 20 in a hallway of the county courthouse after visiting his brother at the county prison in Concord.
When Silberstein greeted Jawwad Rushdi and held out his hand, the other man allegedly “went ballistic,” according to Upper Darby police Superintendent Michael Chitwood.
“You are corrupt, the system is corrupt, Chitwood is a liar, and you and the FBI have been harassing me and my family,” Rushdi told Silberstein, according to an affidavit of probable cause. “You and your people have been killing people overseas and nothing happens to them ... You’re a terrorist.”
When a woman with a black eye overheard the conversation, she tried to calm Jawwad Rushdi down, but he allegedly told her to shut her mouth or he would blacken her other eye. He then said, “I will beat both your asses,” according to police.
Judge Gregory Mallon sentenced Jawwad Rushdi to five years of county probation, in accordance with the plea worked out by Assistant District Attorney Geoff Paine and defense attorney Baltizar Rubio.
Jawwad Rushdi also entered a no contest plea earlier this month to four counts of simple assault stemming from unrelated charges in York County. He had been accused of punching another man over a dispute about a car rental, then engaging in a fight outside the Noor Mosque in York two days later.
Jawwad Rushdi was sentenced to three years probation in that case. The Delaware County probation will run concurrently to the York County probation, under the plea entered Monday, with supervision to be handled by York County.
Ummad Rushdi is meanwhile awaiting a status hearing before Judge James Nilon in the murder case, set for Aug. 4.
